Terms of Sale

These Terms of Sale describe how paid subscriptions and other purchases for CoachEx are offered, billed, renewed, and cancelled. They apply in addition to our Terms & Conditions. Where this page and the Terms & Conditions cover the same subject, read them together.
In these Terms of Sale, “CoachEx,” “we,” “our,” and “us” refer to Coach Ex Machina, Inc.
1. CoachEx services
CoachEx is a personal AI tennis coaching application. CoachEx can record and analyze your tennis swings, provide personalized coaching, allow you to review and discuss recorded swings with your coach, create personalized coaching and Tip videos, and track your progress over time.
Some CoachEx features may require a paid subscription in the future. Available features and subscription plans may change as CoachEx develops.
2. Free launch period
During our current launch period, CoachEx is free to use, including features that may later require a paid subscription, such as Live Coaching.
You will not be charged for using features made available free during the launch period, and you do not need to cancel anything to avoid being charged.
We will provide notice before introducing charges for features that are currently free. You will not automatically become a paying subscriber simply because a free or promotional period ends. Any paid subscription will require you to affirmatively choose and purchase a subscription through Apple's App Store.
3. Future subscriptions and pricing
We expect to offer paid CoachEx subscription plans in the future. Features, prices, billing periods, and other terms applicable to those plans will be displayed in CoachEx and through Apple's App Store before you make a purchase.
The price and billing period shown by Apple when you confirm a purchase will be the price and billing period applicable to that purchase. Prices may vary by country or region, and applicable taxes may be added by Apple where required.
4. How payment works
Paid subscriptions and other in-app purchases are sold through Apple's App Store.
Payment is charged to your Apple Account when you confirm a purchase. Apple processes the payment, issues the receipt, and holds the billing relationship with you. We do not receive or store your payment card details.
5. Automatic renewal
If you purchase an automatically renewing subscription, it will renew automatically unless you turn off automatic renewal at least 24 hours before the end of the current subscription period.
Apple charges the renewal to your Apple Account according to the subscription terms displayed by Apple. Renewal continues until you turn it off.
6. How to cancel
You can turn off automatic renewal at any time through your Apple Account subscription settings.
Cancelling stops future renewals. It does not shorten a subscription period you have already paid for, and you will generally retain access to the applicable subscription features until that period ends.
Deleting CoachEx does not cancel a subscription.
7. Refunds
Purchases made through Apple's App Store are subject to Apple's refund policies. Refund requests for App Store purchases must be submitted to Apple.
We do not control Apple's refund decisions and cannot issue refunds directly for purchases processed by Apple.
If you believe you have been charged in error, you may contact us at support@coachexmachina.com and we will assist where we can.
8. Price and subscription changes
We may introduce, change, or discontinue subscription plans, features, and prices.
If a price change affects an existing subscription, Apple will provide any notice or request for consent required by its policies or applicable law.
Changes to available plans or features will not result in a charge unless you have affirmatively purchased a paid subscription or other paid offering.
9. Changing or cancelling a paid plan
When paid subscription plans are available, you can manage your subscription through your Apple Account settings.
Upgrades, downgrades, cancellations, and changes between subscription plans take effect according to Apple's applicable subscription rules.
Your recorded swings and other content will remain subject to the storage and availability terms applicable to your CoachEx account and plan.
10. Eligibility
You must be legally able to enter into a binding contract to make a purchase.
If you are under 18, a parent or legal guardian must make the purchase and agree to these Terms of Sale on your behalf, consistent with the eligibility requirements in our Terms & Conditions.
11. Governing law
These Terms of Sale are governed by the laws of the State of Washington, without regard to conflict-of-law principles, except where applicable law provides otherwise.
