By accessing or using the CoachEx website, mobile application, or services (collectively, the “Services”), you agree to these Terms & Conditions (“Terms”). In the Terms and Conditions below, the terms “CoachEx,” “we,” “our,” or “us” all refer to CoachExMachina Inc. If you do not agree to these Terms, please do not use the Services.
1. Eligibility and Use by Minors
CoachEx is intended for users of all ages, including junior athletes.
Users under the age of 13 may only use the Services with the involvement and consent of a parent or legal guardian.
By allowing a child under 13 to use the Services, the parent or legal guardian:

agrees to these Terms on the child’s behalf

consents to the child’s use of the Services
-
accepts responsibility for supervising the child’s use of the Services
Parents and guardians are responsible for monitoring minors while using the Services.
2. Description of Services
CoachEx provides AI-powered tennis coaching tools and related services, including but not limited to:

video analysis
-
stroke and movement feedback
-
personalized coaching insights
-
training recommendations
-
performance analytics
-
educational content
The Services are intended for informational and training purposes only.
3. No Medical or Professional Advice
CoachEx does not provide medical, physical therapy, rehabilitation, or professional athletic training services.
Any coaching suggestions, movement recommendations, injury avoidance suggestions, or performance insights provided through the Services are informational only and may not be appropriate for every individual.
Athletic activity involves inherent physical risk. Improper technique, overtraining, or physical exertion may result in injury.
You acknowledge and agree that:

you participate in athletic activity at your own risk
-
you are responsible for exercising appropriate judgment while training
-
you should discontinue activity and seek professional advice if you experience pain, discomfort, dizziness, or injury.
CoachEx does not guarantee injury prevention, performance improvement, or athletic results.
4. AI-Generated Content Disclaimer
Some coaching feedback and recommendations provided through the Services are generated using artificial intelligence systems. While we do our best to ensure the feedback you get from our Coaches is accurate and applicable, AI-generated content may:

contain inaccuracies

be incomplete
-
vary in quality or consistency
-
not reflect optimal coaching practices for every player or situation
CoachEx does not guarantee the accuracy, reliability, or effectiveness of AI-generated recommendations.
You are solely responsible for how you interpret and apply coaching feedback.
5. Accounts
Certain features may require you to create an account.
You agree to:

provide accurate and current information
-
maintain the security of your account credentials
-
notify us promptly of any unauthorized use of your account
You are responsible for all activity that occurs under your account.
6. Subscriptions and Billing
Certain features of the Services require a paid subscription.
Subscriptions purchased through Apple’s App Store are billed and managed by Apple.
For App Store subscriptions:

payment processing is handled by Apple
-
subscriptions automatically renew unless canceled
-
cancellations and refund requests are generally managed directly through Apple
You can manage subscriptions through your Apple account settings.
CoachEx does not control Apple’s billing or refund policies and is not responsible for Apple’s payment processing decisions.
7. Acceptable Use
You agree not to:

misuse the Services
-
interfere with platform functionality or security
-
attempt unauthorized access to systems or accounts
-
upload unlawful, harmful, or infringing content
-
use the Services to harass or harm others
-
reverse engineer or copy the Services
-
use automated systems to scrape or exploit platform content
We reserve the right to suspend or terminate accounts that violate these Terms or misuse the Services.
8. User Content and Data Usage
You may upload videos, images, recordings, swing data, feedback submissions, and other content (“User Content”) to the Services.
You retain ownership of your User Content.
By uploading User Content, you grant CoachEx a limited, non-exclusive license to host, process, analyze, store, and display the content solely for purposes of:

operating the Services
-
providing coaching feedback
-
improving the Services
-
maintaining platform functionality
-
supporting product development and machine learning systems as described below
You represent and warrant that:

you own or have permission to use the uploaded content
-
the content does not violate applicable laws or third-party rights
-
if the content includes a minor, you are the parent, legal guardian, or otherwise authorized to provide that content
At any time, you may delete your User Content using the "Delete My Account" option in Settings under the user name card.
Training and Improvement Data
CoachEx may offer users the option to allow uploaded videos and related training data to be copied, retained, and used for improving our products, coaching systems, artificial intelligence models, and machine learning systems.
This participation is optional and controlled through user settings or consent flows within the Services.
If you choose to enable this option, you grant CoachEx permission to:

copy and retain selected videos and related metadata
-
use the content to develop, train, evaluate, and improve coaching and AI systems
-
create derivative analytical data from such content
If you do not enable this option, your uploaded videos will not be used for AI or model training purposes except as necessary to provide the Services to you.
Anonymous Usage Analytics
CoachEx may collect anonymous or de-identified usage and diagnostic data to improve product quality, coaching performance, reliability, and user experience.
This may include:

application usage patterns
-
feature interactions
-
crash and diagnostic information
-
anonymized coaching interactions
-
swing analysis traces
-
de-identified dialog or feedback data
Where reasonably possible, this information is aggregated, anonymized, or de-identified before analysis.
Users may be given the ability to opt in or opt out of certain analytics collection features within the Services.
CoachEx does not sell personal data to third parties.
9. Intellectual Property
All CoachEx software, branding, technology, designs, graphics, and content (excluding User Content) are owned by CoachEx or its licensors and are protected by intellectual property laws.
You may not copy, reproduce, distribute, modify, or create derivative works from the Services without prior written permission.
10. Service Availability
We may modify, suspend, or discontinue portions of the Services at any time without liability.
We do not guarantee uninterrupted, secure, or error-free operation of the Services.
11. Limitation of Liability
To the maximum extent permitted by law, CoachEx and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

use of the Services
-
athletic activity
-
coaching recommendations
-
AI-generated feedback
-
injuries
-
loss of data
-
service interruptions
Your use of the Services is at your own risk.
12. Indemnification
You agree to indemnify and hold harmless CoachEx and its affiliates from claims, damages, liabilities, and expenses arising from:

your use of the Services

your User Content
-
your violation of these Terms
-
your violation of applicable laws or third-party rights
13. Termination
We may suspend or terminate access to the Services at any time if you violate these Terms or misuse the platform.
You may stop using the Services at any time.
14. Governing Law
These Terms shall be governed by the laws of the State of Washington, without regard to conflict-of-law principles.
15. Changes to These Terms
We may update these Terms from time to time.
Continued use of the Services after revised Terms become effective constitutes acceptance of the updated Terms.
